WILL OF DANIEL STOUT; dated 26 Oct 1769 proved 7 Aug 1770.
        In the name of God, Amen, I DANIEL STOUT of Frederick County in the Colony of Virginia being weak in body and of sound memory this twenty sixty day of October, in the Year of our Lord one thousand seven and sixty nine make and publish my Last Will and Testament in manner following (that is to say) first I give to my three sons Viz GOODFRIED DANIEL, JOHN & GEORGE BENJAMIN STOUT my Tract of Land situated on Stony Creek in Frederick County in the Colony of Virginia to each of them one hundred & fifty acres more or less and first I give to my son GEORGE BENJAMIN STOUT his heirs Executors Administrators or Assigns one hundred & fifty acres of Land more or less it being the upper part of my Tract of Land whereon I now live in Frederick County in the Colony of Virginia from Godlip Links line down Stony Creek with all Buildings and Improvements that is thereon and my Wife, ELIZABETH STOUT, & my two sons, JOHN & GEORGE BENJAMIN STOUT shall keep house together also on that Part of the Land whereon I now live as long as they can agree and my Wife is Willing to keep house and also, I give all my Personal Estate Chattle and household goods and the grain that is now in the field to my Wife ELIZABETH STOUT and to my two sons JOHN and GEORGE BENJAMIN STOUT and if my Wife cant keep house any longer, my son GEORGE BENJAMIN STOUT his heirs Executors and Administrators or Assigns or whoever has possession of the Land I give him, shall give to my said Wife ELIZABETH yearly and every year During her natural life, five bussels of Wheat and six bussels of Rie and fifty pounds of corn and Sow a Quarter of an acre of ground with flax seed and keep her proper use one mare become on his own proper cost and my wife ELIZABETH STOUT send my two sons JOHN and GEORGE BENJAMIN STOUT to school until they have sufficient Schooling. Also I give one hundred & fifty acres of land more or less to my son JOHN STOUT, his heirs Executors Administrators or Assigns next to my son GEORGE BENJAMIN STOUT's land and from his line down Stoney Creek and also I give to my son GOODFRIED DANIEL STOUT, to his Executors Adaministrators or Assigns one hundred and fifty acres of Land more or less beginning at my son JOHN STOUT's line down Stoney Creek to the lower line of my said Tract of Land and my wife ELIZABETH STOUT and my sons JOHN STOUT and GEORGE BENJAMIN STOUT shall give to my son PETER STOUT the value of Five Pounds Virginia Currency in good and chattel after my Decease and they shall also give the value of Twenty Shillings Virginia Currency in goods to each of my two grandchildren, ELIZABETH COFFIELD and DANIEL COFFIELD to be Paid when they come of age or are married & my wife ELIZABETH STOUT shall demand all the money that is due to me and shall therewith Pay all my Debts. LETTERS OF TESTAMENTARY TO H. P. MURPHEY AND SAMUEL HOWARD, ON THE ESTATE OF JOSEPH ROBINSON, DECEASED.
STATE OF TENNESSEE JOHNSON COUNTY } COUNTY COURT, MARCH TERM, 1854.
It appearing to thc Court that Joseph Robinson has died leaving a written Will in which you I. P. Murphey and Samuel Howard are appointed Executors, which has been duly proved in open Court and you having been qualified according to law and it having been ordered by said Court that Letters of Testament issue to you.
These are therefore to empower you the said H. P. Murphey and Samuel Howard to enter into execution of said Will and to take into your possession all the property and to make to the next Court a perfect inventory thereof and make due collection of all debts and after paying all just demands against the Testator and after settling up the business of said estate according to law, you will pay over and deliver the ~ and effects that may remain in your hands and to do all other things that may be required according to the provisions of said Will and the law of the land.
WITNESS, Richard L. Wilson, Clerk of Said Court at office this 6th day of March A.D. 1854.

State of Tennessee
County of Johnson
        On This 24th day of April A.D., one thousand eight hundred and seventy one, personally appeared before me, a Clerk, a Court of Record within and for the county and State aforsaid, HENRY STOUT, aged eighty five years, a resident of Johnson County, State of Tennessee, who, being duly sworn according to law, declares that he is married; that his wife's name was Sarah DOANE, to whom he was married in Washington County, Virginia, on the _____ day of ____, 1805; that he served the full period of sixty days in the service of the United States in the war of 1812; that he is the identical HENRY STOUT who (2l) volunteered in Captain William Neel's company, 7th regiment, in Washington Co. Virginia, on the fifteenth day of September 1814, and was honorably discharged at Norfolk, State of Virginia on or abou the 31st day of March 1815; that (3) that he served in the Virginia State Militia, Infantry; that his first Captain was Elias Bishop, and when he arrived at Norfolk, Va., he was placed under command of Capt. William Neily's; that he was in no general battle, but he and his command during most of the time of his service were stationed in said town of Norfolk; that about the year 1849 he applied and obtained a land warrant; that about the same time he applied through a man by the name of McKamy of Bount Co. Tennessee for pension and his discharge was lost in effort to obtain pension;
that he, at no time during the late rebellion against the authority of the United States, adhered to the cause of the enemies of the Government, giving them aid or comfort, or exercised the functions of any office whateve runder any authority, or pretended authority, in hostility to the United States; and that he will support the Constitution of the United States; that he is not in receipt of a pension under any previous act; that he makes this declaration for the purpose of being placed on the pension roll of the United States, under the provision of the act approved February 14, 1871, and he hereby constitutes and appoints, with full powere of substitution and revocation, Hawkins P. Murphey of Taylorvsille, Tennessee, his true and lawful attorney to prosecute his claim and obtain the pension certifcate that may be issued; that his post office is at Taylorsville County of Johnson State of Tennessee; that his domicile or place of abode is in Civil District NO 5 Johnson Co. Tennessee.

WAR OF 1812 Claim of Widow for Service Pension.
        Under the provisions of Sections 4736 to 4740, Revised Statutes, and the Act of March 11, 1878...
        State of Tennessee County of Carter, ss.
        On this __ day of November, A.D., one thousand eight hundred and Seventy eight, personally appeared before me George T. Williams, the same being a court of record within and for the County and State aforesaid, (2) KIZZIAH STOUT, age ___ years, a resident of Stoney Creek, in the State of Tennessee, Carter county, who, being duly sworn according to law, declares that she is the widow of (2)HENRY STOUT deceased, who was the identical (3) Henry Stout who served under the name (4) Henry Stout as a (5) private, in the Company commanded by Captain William Neilys in the Virginia Militia, command by not known in the War of (6) 1812; that her husband (7) Enlisted at Meeks in Virginia on or about the day ___ March A.D. 1815. She further states that the following is a full description of her said husband at the time of his enlistment; viz: (10) She cannot state as she was not ______ with said Stout at his enlistment. She further states that she was married to said Henry Stout, at the city (or town) in 7th Civil District, in the county of Johnson and in the State of Tennessee on the 8th day of March A.D. 1861 by one (11) H. P. Murphy, who was a (12) Justice of the Pease; and that her name before her said marriage was Kizziah WRIGHT; and she further states that (13) said Stout had a fomer wife by the name of _____ who died many years ago but dont know when or where and that her said husband (14) Henry Stout, died on Stoney Creek, in the State of Tennessee Carter Co. on the 26th day of October A.D. 1878; and she further declares that the following have been the places of residence of herself and her said husband since the date of his discharge from the Army, viz: (15) in Johnson & Carter Couty Tennessee since their said marriage before she cannot state. She makes this declaration fo rthe purpose of obtaining the Pension to which she may be entitled under Sections 4736 to 4740, inclusive, Revised Statutes, and the Act of March 11, 1878, and hereby appoints R. R. Butler of Taylorsville, Johnson Co. Tennessee, her true and lawful attorney, to prosecute her claim.
        And she further declares that she has heretofore made no application for (16) pension, but fher said husband, was a pensioner on account of said service his certificate pension is herewith filed and her residence is County of Carter State of Tennessee, and that her post office address is Carters Furnace Carter County Tennessee.

Hurley, aged 52 years, residing in Elizabethton, persons whom I certify to be respectable and entitled to credit, and who, being by me duly sworn, say that they have known the said Kizziah Stout for 40 years and for 40 years, respectively; that they were present and saw her sign her name (or make her mark) to the foregoing declaration; that they have every reason to believe, from the appearance of said claimant and their acquaintance with her, that she is the identical person she represents herself to be; and they further say that they are able to identify her as the person who was the wife of the identical (17) Henry Stout, who rendered the servive alledged in the above application (in the company of Captain William Neily, in the regiment of Virginia Militia in the War of 1812) by6 the following named facts and circumstances, viz( 18) by being well acquainted with them both & seeing them living together as husband & wife.

On 6th June 1879.... James K. Anderson and Valentine GARLAND... They are well acquainted with Kizsiah Stout, and with her husband Henry Stout. That they know the said Henry Stout died on the 26 day of October 1878 because the saw the corpse and were at his burying. That they live almost insight of the said Kizsiah and see her almost every day and sometimes several times a day....

    In the Name of God, Amen. I John Schaun of Germany Township in the County of York in the Province of Pennsylvania Yeoman being in good bodily Health and of a Sound and well disposing mind Memory and Understanding Thanks be therefore humbly Offered unto the Lord and for all others his Mercies Having considered the Uncertainty of Life and certainty of Death thought fit to Settle my worldly Affairs and I do hereby make my Last Will and Testament in Manner following hereby Revoking all Wills and Testaments by me at any time heretofore made and I do Declare this and no other to be my Last Will and Testament, that is to say Principally and of all Things I do Recommend my Soul in the Hands of God who gave it and my Body to the Earth to be buried in a Decent Manner. RESIDENCE: In 1790, Arthur Pierce was taxed in Washington Co. North Carolina. In 1791 he was still in Richard White District, as were Samuel McQueen and Rowland Jenkins

Arthur Pierce was the earliest Pierce found in Carter Co. TN on Jan 1, 1808. Arthur moved to Overton County about 1818.

1820 CENSUS, Paoli, Cumberland County, KY, page 47/152: Arthur Pierce, between age 26 -45, 2 daughters under age 10, wife between 16-26 (next door to Samuel Cole and near William Tompkins, his father-in-law):

1830 Census: Carter County: Arthur Pierce and wife between age 50-60, 1 son under age 5, 1 son age 15-20 (born between 1810 and 1815), one daughter age 20-30.

1840 Census: Overton County, TN: one male age 10-15, arthur age 60-70, two females age 0-5, one female age 20-30,

HISTORY: The Pierces now living in Pickett Co Tenn are all descendants of Arthur and Hardy Pierce who were supposedly brothers. Arthur & Hardy were born in North Carolina during the 1770's. They came to East Tenn in the early 1800's and were in Overton Co., Tenn, (now Pickett Co., Tenn) in the Oak Hill Community by 1830. Arthur & Hardy Pierce were both members of the Wolf River United Baptist Church. Arthur was dismissed from the church. It appears Arthur may have moved back to East Tenn and then returned to Overton Co., Tenn where he was living in 1850 with the family - listed above . According to Caryle Amonett, the early Pierces were blacksmiths, and their shop was located on the present John L. Johnson farm in the Oak Hill Community of Pickett Co Tenn. Arthur died in 1854. History of Families in Pickett Co Tenn.

        In 1819, The Sewells, The Tompkins, The Cargills, The Staleys, The Parsons, The Pierces and others who had come from WILKES CO North Carolina and settled along the Wolf River, formed the nucleus for the membership of Wolf River Baptist Church. Arthur Pierce donated the original site for the church. Later a "reform movement" led by "Raccoon John" Smith, Alexander Campbell, Jonathan Young and the Sewell brothers, left the congregation in August of 1842 and started another church later to be known as the Christian Church.

Arthur divorced his first wife to marry a younger woman. His 2nd wife died.
His 3rd wife was excluded from Wolf River United Baptist Church on June 1, 1825, "for swearing on a Bible, making mischief between Viney Cole and husband, and being unreasonable in the correction of Mary Ann's stepchildren. Arthur and 3rd wife, Mary Marbrey divorced.


No proof that Mary Fitzgerald was wife of Arthur. Our family bible did not list Griffin Pierce's mother. The name has come from other researchers. I did find a NC will record online for John Fitzgerald who died 1751 and mentioned his daughter Mary Fitzgerald Pierce and husband Arthur. These dates make it impossible to be this Arthur Pierce.
There is confusion among researchers about Hardy and Arthurs children.

This Indenture made the first day of January in the year one thousand
eight hundred and eight Between John Carriger of the County of Carter & state
of Tennessee of the one part and Arthur Pearce of the County of Carter
and State aforesaid of the other part Witnesseth that the said John Car
riger for and in consideration of the sum of one hundred & fifty Dollars
to him in hand paid, the receipt whereof is hereby acknowledged hath
and by these presents doth grant, bargain, [illegible] and confirm unto the said
Arthur Pearce his heirs and assigns forever a certain tract or parcel of land containing
two hundred acres lying and being in the County of Carter on the blue spring branch
Beginning at a chestnut & black oak running west one hundred seventy poles to a sycamore
